Steven Scholes warned that corporate counsel should not approach an SEC investigation by using the same close-to-the-vest tactics typical of a commercial lawsuit. “We get a lot of referrals of cases where clients either tried to deal with these things on their own initially or counsel is not accustomed to dealing with enforcement staff at the SEC, and they caused themselves more problems than they had in the first instance,” Mr. Scholes said.
