McDermott secures judgment for Tract Capital, granting Nevada data center development

A cross-office team for international law firm McDermott Will & Schulte secured a complete win for Tract Capital Management, LP (Tract) in its dispute with Switch, Ltd., following two years of litigation over the right to develop land for hyperscale data centers near Reno, Nevada. The win frees Tract from a restrictive land covenant on a 600-acre parcel for development and sale to Tract’s clients. The Court granted Tract’s motion construing the covenant October 7, 2025, prompting Switch to concede that Tract was entitled to judgment on all of Switch’s claims.

The McDermott team was led by Michael Dockterman and included Matt Madden, Emilie O’Toole, Joe McClure, Leah Palmer, Hafsa Tout, Hallie Fox, and Luke Bianco, with support from Margo Eckstein and Rebecca Schnitz.
