Joseph (Joe) McClure focuses his practice on complex commercial litigation, with an emphasis on data center and digital infrastructure disputes arising from large-scale real estate development projects. He has significant experience litigating matters arising from the development of data centers, including disputes over property rights, land use and zoning, restrictive covenants, development approvals and entitlements, contractual issues, and related regulatory and infrastructure challenges.
Joe represents clients in both jury and bench trials in state and federal courts. His commercial litigation experience includes cases involving data privacy, trade secrets, national security, government contracts, insolvency, and complex accounting and financial issues. Joe frequently works with expert witnesses to develop and present financial condition evidence in evidentiary hearings, at trial, and in dispositive and post-trial briefing. Notably, Joe played a key role in a major fraudulent transfer case, collaborating closely with financial experts to analyze accounting practices, value transferred assets, calculate damages, and present those findings at trial and in post-trial proceedings. He also developed a novel damages theory that was adopted by the trial court in awarding a $170 million judgment to the plaintiff.
Prior to joining the firm, Joe was a law clerk to the Honorable David A. Tapp of the US Court of Federal Claims.
