42 CFR Part 2 Proposed Rule

On December 2, 2022, the US Department of Health and Human Services proposed long-awaited changes to the regulations that govern the confidentiality of substance use disorder patient records (42 CFR Part 2). The proposed rule would make it easier for substance use disorder treatment providers and other recipients of substance use disorder treatment records, such as health plans, to use and disclose substance use disorder patient records for treatment, payment and healthcare operations as currently permitted by the Health Insurance Portability and Accountability Act (HIPAA). The proposed rule also seeks to align other provisions of 42 CFR Part 2 more closely with HIPAA.

In this webinar, we will discuss key provisions of the proposed rule and their potential impact on stakeholders. We will also review potential areas for comment.
