DISCUS Academy Discounting Rules - McDermott Will & Emery

DISCUS Academy Discounting Rules

Overview

Discounting programs and consumer sweepstakes promotions can be crucial avenues to promote beverage alcohol brands. These programs can be confusing to establish, however, due to the restrictive nature of state laws and many other considerations that must be taken into account, such as identifying retail or wholesale partners, types of couponing (IRC vs mail-in), and what prizes may be awarded to the consumer. This Elective Course will detail the various types of discounting and sweepstakes promotions, how state laws differ widely regarding discounting, and how to best establish these programs. This course will also explore quantity discount and channel pricing programs and share couponing and sweepstakes best practices from industry members.

Learning Outcomes:
1. Learn the complicated web of state laws and how to find the often-elusive state regulatory or policy guidance to inform your discounting decisions
2. Understand quantity discount and channel pricing issues and how to analyze these programs on a state-by-state basis
3. Gain the tools to analyze the state markets you operate in for discounting or couponing opportunities, understand some of the different forms these programs can take, where to find the state regulatory information, and how to best establish these important programs
