Kisor v. Wilkie: Webinar Series

On Wednesday, June 26, 2019, the Supreme Court issued its decision in Kisor v. Wilkie, No. 18-15, addressing the doctrine of Auer deference. In a fractured 5-4 decision, only part of which commanded a majority of the Justices, the Court declined to overturn Auer. But the Court imposed significant limitations on Auer’s applicability, creating substantial new opportunities for the regulated public to challenge adverse agency action.

McDermott partners Paul Hughes and Michael Kimberly, co-chairs of McDermott’s Supreme Court and Appellate Practice, represented petitioner James Kisor, with Paul arguing the case. Please join Paul and Michael for a three-part webinar series addressing Kisor’s key implications, focusing on how they may be practically used. In this series, McDermott partners from McDermott’s tax and health care practice groups will join in discussions on the following three topics:

  • July 8, 2019 1:00 pm (EDT): Kisor and Tax
    •  A presentation focusing on Kisor‘s implications in the field of tax.
  • July 9, 2019 1:00 pm (EDT): Kisor and Health
    •  A presentation tailored to Kisor’s repercussions in health law, including the recent Supreme Court decision Azar v. Allina Health Services.
  • July 10, 2019 1:00 pm (EDT): Kisor deference – What happens next?
    •  After describing Kisor’s critical holdings and ways to use them in litigation, we will consider the next wave of litigation regarding agency deference.

Each webinar will conclude with a Q&A opportunity. To register for one or more webinar, please follow the link below to sign up. We look forward to hearing from you all.
