Kisor v. Wilkie: Webinar Series

Overview


On Wednesday, June 26, 2019, the Supreme Court issued its decision in Kisor v. Wilkie, No. 18-15, addressing the doctrine of Auer deference. In a fractured 5-4 decision, only part of which commanded a majority of the Justices, the Court declined to overturn Auer. But the Court imposed significant limitations on Auer’s applicability, creating substantial new opportunities for the regulated public to challenge adverse agency action.

McDermott partners Paul Hughes and Michael Kimberly, co-chairs of McDermott’s Supreme Court and Appellate Practice, represented petitioner James Kisor, with Paul arguing the case. Please join Paul and Michael for a three-part webinar series addressing Kisor’s key implications, focusing on how they may be practically used.
