Erin Turley will present “Developments and Trends in ESOP Participant Lawsuits, DOL Investigations and IRS Audits.”

This session is presented by three front-line ESOP advisors: an attorney who has handled some of the most complex ESOP transactions,‎ DOL Investigations and IRS Audits; an accomplished ESOP valuation expert in a firm that structures some of the most innovative ESOP transactions; and a trial lawyer who has defended ESOP fiduciaries in the most prominent participant and DOL lawsuits. The panel will identify recent developments and trends in DOL investigations, IRS audits and lawsuits, and focus on steps ESOP fiduciaries can take to protect, prepare, and defend themselves. The session will include information on how to conduct an internal “pre-audit” for readiness before the DOL or IRS come knocking, and on how fiduciary insurance and indemnification provisions impact the allocation of responsibility and costs for an audit, investigation and/or defense of a lawsuit.
