Russell Hayman and Jon Dean wrote this bylined article posing questions to help in-house lawyers assess several months beforehand if their litigation counsel should remain lead trial counsel in a case going to trial. Positive answers, the authors wrote, mean “you should be well-positioned for your upcoming jury trial,” but negative ones make it “critical to ask whether the company should bring in new trial counsel to present your case to the jury.
