“While the financial markets continue to make significant investments in financial restructuring professionals ahead of an expected wave of insolvencies, we can expect lawmakers to extend latitude to companies to protect their going concern value. This breathing space will be very helpful to companies trying to best understand the economic landscape that they are returning to and none more so than companies in the retail sector. It may well be that the government has decided to act here because there has historically been a significant delay between market-wide financial decline and a corresponding reduction in lease costs as landlords try to maximize periods of profitability.”
