“Given the heightened focus on the protection of businesses as a going concern, as evidenced by the recent changes to UK insolvency legislation, it is only natural that where a going concern rescue is not the final outcome, there will be greater scrutiny of the process. This is even more the case for businesses, in those sectors like leisure and retail that are household names with the potential for large-scale job losses when such an outcome cannot be achieved.”
