Jeremy White attributed a large increase in wage and hour class actions to increased challenges in certifying employment discrimination class actions following the Supreme Court’s Wal-Mart v. Dukes decision. “We’re not just talking about overtime pay, but claims relating to unpaid meal and rest periods, how frequently you pay employees and how soon someone has to be paid upon separation from the company,” Mr. White said of the wage and hour suits.
