Todd Solomon said that, while the opinion drafted by influential Seventh Circuit Judge Richard Posner striking down same-sex marriage bans in two states may have a strong impact on public opinion, the effect on other courts may be more muted because many have already concluded that prohibitions on same-sex marriage violate the 14th Amendment’s equal protection guarantee. “I don’t know that Posner’s decision is going to affect other courts, because other courts have seemed to get it,” Mr. Solomon noted. “They’ve long since been heading in the same direction.”
