9th Circuit: California’s Strict Independent-Contractor Test Applies Retroactively


Ron Holland commented on the Ninth Circuit’ ruling that California’s new „ABC“ test for determining whether a worker is an employee or an independent contractor applies retroactively. There are now significant questions about whether it is advisable to hire independent contractors, said Holland. Examining current and prospective contractor relationships is critical, he noted, and even more so now that the Ninth Circuit has weighed in.
