High Court Puts EPA Power Plant Rules on Firmer Ground


Jacob Hollinger predicted that a Supreme Court decision backing the U.S. Environmental Protection Agency’s Cross-State Air Pollution Rule “is really going to boost EPA’s confidence with respect to its ongoing rulemaking for power plants.” Mr. Hollinger noted that the Court’s decision hinged on “an ambiguous provision of the Clean Air Act,” and “the bottom line of that decision is that you had six justices say … we’re going to defer to the agency [on] the interpretation of the provision.”
