The Future for Collective Action Under The GDPR Afternoon Workshop

Ashley Winton (Regulatory – LON) and Boris Uphoff (IP – MUN) were speakers at a European seminar where Ashley presented on “Precedents in the United Kingdom,” explaining the new types of failures that will give rise to valid claims under the GDPR in English law, types of existing claims and how they have been brought in the English courts, and using the GDPR to bring new types of claims, and how this will work in practice.

Boris presented “Enforcing Claims as a Group” discussing that while there is no collective redress similar to US class actions in continental Europe, there are hybrid means to enforce claims as a group as well as answering what we can learn from these hybrid means and how can they be transformed into collective redress as required by European data privacy laws. His second topic  “Implementation of Collective Action”, addressed which procedural rules need to be implemented, how damages are calculated and how proceeds from damages claims will be distributed.
