The authors described the process to bring civil law patent infringement litigation in Germany’s 12 district courts and discussed such recent trends as a stricter case law approach toward infringement by equivalents, more willingness of German infringement courts to assume an infringement in Germany even if the infringer only acted abroad, and personal CEO liability for company infringement.
