Overview
Fabio Cozzi heads the Italian dispute resolution practice and focuses his practice on cross-border litigation, domestic and international arbitration, compliance, financial crime and international trade.
He advises corporations, financial institutions and investment funds in complex disputes, often spanning multiple jurisdictions, as well as domestic and international arbitration proceedings in a range of commercial, corporate, real estate, energy, bankruptcy, financial and technology-related matters.
Fabio also counsels corporate clients and financial institutions on compliance and international trade issues, assessing the risk deriving from trade restrictions, economic and financial sanctions and advising on internal investigations related to corruption and financial crime.
Results
- Assisted a global leader in airport concessions and management, and a construction company operating in the transport, hydraulic, infrastructure and oil & gas sector in multiple disputes (for an overall value of EUR 150 million) with an Italian construction company in connection with a construction project*
- Assisted a multinational energy company in a complex institutional arbitration concerning the sale of multiple branches of business, involving hydroelectric plants, in a related urgent proceeding for the cautionary seizure of the assets, and in the subsequent proceedings to set aside the award*
- Assisted a US company in an ad hoc international arbitration proceeding based in Singapore against a multinational Asian company in connection with a USD 2 billion claim for breach of a joint venture agreement*
- Assisted a global investing firm – with USD 369 billion of assets under management – in a complex dispute related to the restructuring of the financial indebtedness of an Italian multinational company (operating in more than 70 countries)*
- Assisted an international financial institution on a complex multi-party arbitration and in the subsequent proceeding for setting aside the award in connection with the breach of a share purchase agreement and a contractual fraud related to the sale of a EUR 160 million-value personal care retail chain*
- Advised a leading multinational iron and steel manufacturer in complex multiple disputes, for an overall value of USD 80 million, related to an alleged liability for direction and coordination activity, infra-group financing and relevant bankruptcy law issues*
- Assisted multiple investors with respect to investor-state disputes under the Energy Charter Treaty*
- Assisted an international insurance group in dealing with EU Member State Authorities and the EU Commission in connection with EU sanctions targeting Russia and in the implementation of the appropriate remedies to mitigate the risk of violations*
- Assisted a Chinese multinational conglomerate in the listing on the Hong Kong Stock Exchange to assess the risks associated with economic restrictions imposed by the US, the UN/EU and on drafting appropriate compliance procedures and policies*
- Assisted one of the largest plastics, chemicals and refining companies in the world listed at the NYSE in connection with the termination of its business operations in Iran and the settlement of the claims with an Iranian energy company, as well in connection with the compliance with EU sanctions*
- Assisted a European financial institution in connection with the internal investigation and subsequent implementation of remedies related to the breach of US financial sanctions targeting Iran, Cuba and North Korea*
- Assisted a European leading financial institution in the context of a whistleblowing procedure, and subsequent internal investigation, in connection with the alleged misbehavior of a senior manager*
