Overview
Maxwell C. Preston focuses his practice on trademark and copyright counseling, prosecution, portfolio management and enforcement. He represents clients in a wide variety of industries, including the fashion, technology, e-commerce, media, publishing, furniture, alcoholic beverage, cosmetics, automotive, software development, telecommunications and consumer electronics industries.
Maxwell also regularly prepares IP agreements and performs IP due diligence for corporate and commercial transactions. He drafts and negotiates assignment and license agreements, coexistence agreements, co-branding agreements, and publishing agreements, as well as settlement agreements.
In addition, Maxwell has extensive experience managing IP and domain name disputes, including litigation in federal court, trademark oppositions and cancellations before the Trademark Trial and Appeal Board (TTAB), and proceedings pursuant to the Uniform Domain Name Dispute Resolution Policy (UDRP).
