EU Data Act | Impact for Japanese Companies - McDermott Will & Emery

EU Data Act | Impact for Japanese Companies

Overview

Within the new EU Digital Package, the Data Act is intended to shape the flows of personal and non-personal data between private entities and, for exceptional purposes, with public sector bodies. In this context, it notably focuses on the sharing of connected devices and related connected services’ data, but not only. It will also regulate the cloud business in order to support switching by customers from one service provider to another. Above all, the Data Act will have implications for countries far outside Europe, and Japanese businesses in particular should take note of the requirements imposed.

In this interactive webinar, we will discuss key obligations under the Data Act, with a focus on the connected devices and related connected services. Our discussions will include:

  • What is the place of the Data Act within the EU Digital Package?
  • Territorial and material scope of application – What are the impacts for Japanese industries/companies?
  • Focus on the connected devices and related connected services – What data fall within the scope of the Data Act? What line to draw to comply with the Data Act requirements?
  • Beyond connected devices and related connected services (sharing with public sector bodies, easy switching between data processing services) – what are the other key obligations for Japanese companies under the Data Act?
