The ban “may not immediately make its way into law with time running out on the current legislative session,” the authors wrote, but “strong forces within Massachusetts are committed to changing the longstanding law applicable to noncompetes.” As a result, they concluded, it “is not open to question is that employers can no longer be certain that noncompetes with officers and key employees will remain enforceable as intended.”
