The Office of the National Coordinator for Health Information Technology (ONC) released its long awaited final rule adopting exceptions to the Cures Act’s information blocking prohibition and updates to the ONC’s health IT certification program. At the same time, the Centers for Medicare and Medicaid Services (CMS) released a final rule on the related topic of interoperability.

March 23, 2020: ONC Final Information Blocking Rule
12:30 – 1:30pm EST

The ONC’s information blocking prohibition applies to certified health IT developers and health care providers, as well as health information exchanges and health information networks. It prohibits certain fees and other practices that unreasonably interfere with access, exchange or use of electronic health information. March 26, 2020: CMS Interoperability Rule

CMS’s final rule requires that CMS-regulated payors implement APIs that allow patient information to be shared more readily among patients, health care providers and payors. It also imposes a new Medicare condition of participation that requires hospitals, which have implemented EHR systems, to engage in event reporting with community providers.
