On April 25, Elliot Golding, Amy Pimentel and Saba Bajwa are presenting in an American Bar Association (ABA) webinar titled, “Evolving AdTech Requirements in the Healthcare Space.” Their discussion will focus on how health tracking technologies work, the recent enforcement activity and practical tips to use such technologies while mitigating associated risks.

Health and life sciences companies that use cookies and other tracking technologies are facing a rapidly evolving landscape and significant new risks, including a spike in regulator enforcement (by OCR, FTC and state regulators) and private litigation. In the past few months alone, OCR issued a Bulletin providing guidance about when HIPAA applies to such technologies, the FTC has announced two major settlements with health companies related to such technologies and new rules took effect in California and Virginia.

Discussion topics will include:

  • An explanation of cookies, pixels and other tracking technologies
  • Guidelines to determine what information is collected through online tracking technologies
  • Analyzing when information collected online is HIPAA protected health information (PHI) and/or subject to other legal regimes (such as the FTC’s PHR Rule and state privacy laws)
  • Practical tips to address compliance obligations
  • How to handle risk of compromise assessments for unauthorized disclosures to tracking technology vendors
