Overview
Andrew A. Mark advises debtors, creditors, and other stakeholders in complex restructuring transactions and bankruptcy proceedings, including Section 363 asset sales, debtor-in-possession (DIP) financings, special committee investigations, and the solicitation and confirmation of chapter 11 plans.
During law school, Andrew served as a judicial intern for President Judge Emeritus Susan Peikes Gantman of the Superior Court of Pennsylvania, the late Honorable Kevin J. Carey of the United States Bankruptcy Court for the District of Delaware, and the Honorable Kevin Gross of the Bankruptcy Court for the District of Delaware. Before entering private practice, he also served as a law clerk for the Honorable Karen B. Owens of the Bankruptcy Court for the District of Delaware.

- Represented a pharmaceutical company and its affiliates in connection with expedited litigation over contested DIP financing*
- Represented a global specialty pharmaceutical company in litigation over the ownership of a clinical trial drug research package in another pharmaceutical company’s chapter 11 proceedings, ultimately securing sole and exclusive ownership of the research package for the client under a pre-bankruptcy co-development agreement*
- Represented a software and cloud services company as the prior lender and asset purchaser in a tech startup’s chapter 11 case regarding a motion to enforce a sale order*
- Represented a biopharmaceutical company and its affiliates in connection with chapter 11 proceedings, including negotiating the use of cash collateral and managing the Section 363 sale process*
