This past year the Supreme Court and Federal Circuit redefined and continued to define key aspects of intellectual property (IP) law, and the Court is showing no signs of slowing down in 2018. These cases ranged from:
- Issues regarding proper venue to laches defenses
- Arguments related to whether or not the inter partes review proceedings at the United States Patent and Trademark Office (USPTO) are constitutional
- Attempts to resolve the clash between longstanding trademark registration rules and the First Amendment
Answers to questions regarding the effects of Trump’s presidency and who would be appointed to the Supreme Court and USPTO are becoming clearer as we launch into 2018.
