McDermott’s Global Privacy & Cybersecurity team is hosting a webinar series that delves into the most significant policy initiatives shaping the digital landscape in Europe: the respective EU and UK Digital Strategies. They encompass a comprehensive set of policies and legal instruments aimed at enhancing digital competitiveness, strengthening digital rights and fostering digital resilience across the European Union and the United Kingdom.

During the first webinar in the series, Rosa Barcelo, Simon Mortier and Matúš Huba took a closer look at six of the main legal instruments comprising the EU Digital Strategy: the Digital Markets Act (DMA), the Digital Services Act (DSA), the Data Act (DA), the Artificial Intelligence Act (AIA), the Data Governance Act (DGA) and the European Health Data Space (EHDS). They covered the potential implications for US and global companies with operations in Europe and to whom the six legal instruments apply.

Top takeaways included:

  1. While the scope of some of the regulations under the EU Digital Strategy may be narrow and many organizations will not be directly covered by it, these regulations will have significant indirect implications for the industry at large.
  2. It is important not to lose sight of the fact that certain players in the market will undoubtedly take advantage of the opportunities that these regulations will create (e.g., by creating value out of the data obtained through the many data-sharing obligations these regulations establish). It is therefore important to anticipate this before a competitor does.
  3. Robust enforcement mechanisms will underpin the Digital Package, including in some cases new dedicated enforcement bodies as well as powers to impose huge fines, which makes ignoring these regulations not a wise decision.
