Enforcement Outlook | Key DOJ Enforcement Priorities for the Year Ahead

Overview

Despite widely announced policy shifts in certain areas, the Department of Justice (DOJ) continues to be active in opening investigations and bringing cases, particularly those focused on healthcare fraud, wire fraud, and securities fraud. Moreover, DOJ announced record case numbers and settlements under the False Claims Act in 2025.

Join members of McDermott Will & Schulte’s Global White-Collar & Government Investigations Group as they examine key trends shaping DOJ priorities in the year ahead and provide practical guidance on how organizations can continue to refine existing policies and compliance programs – and what they should anticipate – in the months ahead.

Discussion topics will include:

  • Implications of the recently announced White House Fraud Enforcement Initiative
  • The False Claims Act enforcement priorities in 2026
  • DOJ’s use of federal criminal statutes to investigate policy priorities, including recent investigations into corporate diversity, equity, and inclusion programs and providers of gender affirming care
  • Changes and updates to the DOJ’s self-reporting policies, including recent changes to U.S. Attorney’s Office for the Southern District of New York’s revised voluntary self-disclosure program
  • Practical strategies for mitigating enforcement risk in the year ahead
