Overview
Joseph (Joe) McClure focuses his practice on complex commercial litigation, which spans cases involving real property, commercial development, data privacy, trade secrets, national security, government contracts, and insolvency. Joe has experience with both jury and bench trials in state and federal court.
Joe has particular experience with cases involving accounting and financial issues, often assisting teams in presenting financial condition evidence during evidentiary hearings, through expert witnesses and in briefing. Notably, he handled a major fraudulent transfer case where he collaborated closely with financial experts to investigate accounting practices, value transferred assets, calculate damages, and present those findings both at trial and in post-trial proceedings. Joe developed a novel damages theory which was ultimately adopted by the trial court in awarding a $170 million judgment to the plaintiff.
Prior to joining the firm, Joe was a law clerk to the Honorable David A. Tapp of the US Court of Federal Claims.
Results
- Represented a horizontal developer and its affiliates in litigation over property rights related to the construction of data centers, and secured a judgment for the developer
- After a four-week trial, secured $170million judgment on behalf of an operator of a crude-by-rail transloading facility pursuing fraudulent transfer claims arising from a breach of a take-or-pay contract. The trial victory was recognized by AmLaw’s Litigation Daily, including Joe among the “Litigator of the Week Runners-Up”*
- Represented an insurer in a $400 million fine art coverage dispute and, after a three-week trial, secured judgment for the insurer. The trial victory was recognized by AmLaw’s Litigation Daily, including Joe among the “Litigator of the Week Runners-Up”*
- Represented a defense contractor against tort suits arising out of Abu Ghraib prison scandal in two separate jury trials*
- Represented a major accounting firm in a US Department of Justice and Securities Exchange Commission investigation of a foreign manufacturer*
- Defended an educational technology company in a proposed class action alleging that the use of a pixel web tracking technology caused violations of the Video Privacy Protection Act*
